- Child SupportA significant revision of the statutes defining how child support is calculated in Illinois went into effect on July 1, 2017. Prior to this change, the amount of child support payments was determined using a percentage of the paying parent's net income based on the number of children being supported. Under the revised law, Illinois now uses an income sharing model in which the basic support obligation for a child will be determined using both parents' combined net income, and each parent will be responsible for a portion of that obligation based on their percentage share of the combined income. Each parent's individual amount of parental responsibility and parenting time will also be considered.
- Child Custody and VisitationThe updated IMDMA provides a new way for parents and the courts to think about raising a child following a divorce, separation, or break-up. The previous version of the law provided two options for parenting situations: sole custody or joint custody. In a sole custody arrangement, one parent would be granted all of the authority for important decision-making regarding the child, while such responsibilities would be shared by both parents under a joint custody order. Titles such as custodial and non-custodial parent tended to imply that one parent was more important than the other, often leading to bitter, drawn-out battles over child custody.
