Criminal Defense: Criminal law is the body of law related to crimes and punishment. It includes conduct classified as a felony, such as murder or robbery, or a misdemeanor, such as OUI/DUI or simple assault. Punishments for crimes can range from a fine to imprisonment. It includes criminal conduct by military personnel and various administrative disciplinary proceedings and adverse personnel actions. Military lawyers represent and defend military personnel facing court-martial for alleged criminal conduct. They also represent military members in nonjudicial punishment (Article 15) proceedings, involuntary discharge proceedings, flying evaluation boards, physical evaluation boards, medical credentials hearings, and a variety of other proceedings. Military lawyers also assist members and former military members with applications to and hearings before the Boards for Correction of Military Records and Discharge Review Boards. I am a retired Air Force Judge Advocate with over 20 years of experience in military law. Appellate Law: Appellate practice deals with the presentation of cases to courts charged with review of lower court decisions and judgments. Each court system has its own system of review. In most jurisdictions, judgments and decisions of the trial court are reviewed by intermediate courts of appeal before they are eligible for review by the jurisdiction's highest court. For instance, in Massachusetts decisions of the Commonwealth's trial courts are usually reviewed first by the Appeals Court before they are eligible for review by the Massachusetts Supreme Judicial Court. In the Federal system, decisions and judgments of the District Courts are reviewed by a United States Court of Appeals and then the Supreme Court of the United States. The military also has its own appellate system. Courts-martial are reviewed first by the service's Court of Criminal Appeals and then by the United States Court of Appeals for the Armed Forces (USCAAF).
