- Landlord-Tenant DisputesBecause the lease terms govern the landlord-tenant relationship, a clearly written and precise lease may prevent expensive litigation. CLF will review your current lease documents to determine weaknesses and suggest modifications or changes which can lead to long-term cost savings for our clients. Personal guarantees and/or letters of credit are vital to ensure the collectability of damages from tenants in violation of their leases. A clearly written lease with precise lease terms can often be used as convincing leverage to compel a tenant’s compliance rather than resorting to eviction and inheriting a vacant space.

- ForeclosureAfter the residential housing market crashed in 2008, due mainly to the securitization of mortgage contracts, tens of thousands of Floridians lost their homes. Lenders, attorneys, and mortgage services fabricated documents in astounding numbers to facilitate foreclosures. The thousands of fabricated documents used by national banks and trusts, drew my firm’s attention to this area of the law. At first, the courts in Florida protected homeowner rights by disallowing reliance on the fabricated documents. Unfortunately, over the past 10 years, the homeowners’ rights in regard to these faulty documents have diminished greatly. Despite the change in jurisprudence, some case law survives that protects against actual fraud. If you believe your rights as a homeowner have been violated based on fraudulent documents utilized in foreclosure, contact our office for a phone consultation to discuss potential options.
