- Criminal DefenseA Certified Civil Trial Attorney is a designation granted by the New Jersey State Supreme Court to attorneys who are able to demonstrate sufficient levels of experience, education, knowledge, and skill in civil trial practice. The Supreme Court, through its Board on Attorney Certification, designates only those attorneys who apply for certification and are able to meet the rigorous standards set by the Board and approved by the Court. It is an honor held by only approximately 2% of practicing attorneys in the State of New Jersey. At present, there are four specialties areas of practice that are approved for certification: civil law, criminal law, matrimonial law, and workers’ compensation law

- MurderA common example of this is murder. When a person takes another’s life, he or she can be prosecuted for murder in the criminal system, and may also face a civil lawsuit for wrongful death in the civil system. If the person is found liable for the death, the court can order the person to pay compensation to the victim’s family members. It’s also possible for someone to be acquitted of a crime, such as murder, but be found liable for a wrongful death in a civil lawsuit. Perhaps the most infamous example of this is the O.J. Simpson case, in which Simpson was found not guilty of murder in criminal court, but was found liable for the wrongful deaths of his ex-wife and her friend in civil court. These disparate results are possible because the burden of proof in criminal cases is much higher than that in the civil justice system: “beyond a reasonable doubt†versus “a preponderance of the evidence.â€
- Workers Compensation
- Premises LiabilityAccording to New Jersey law, property and business owners have an obligation to keep their properties free of hazards that can cause people harm. This obligation falls under the legal category of “premises liability.†These cases are often complicated because proving a person or entity had a legal duty to remove a hazard or to warn others of the presence of a hazard is not always straightforward.
- Property DamageIn most tort cases, however, there is not a criminal component or counterpart. Instead, the individual who committed the tort must pay for the damages caused by his or her negligence, assuming the wrongdoer is found liable for negligence. Depending on the details of the case, damages can include the injured party’s medical bills, lost wages, property damage, future medical expenses, loss of future earnings, loss of companionship, and other damages.

This means dog owners can be held responsible for injuries caused by their dogs, even in cases where the dog never acted viciously in the past. The strict liability statute applies in cases where the dog attacks a person in a public place, as well as cases in which the dog bites someone on the dog owner’s property.
