- Workers Compensation InsuranceLiability insurance (including self-insurance), no-fault insurance, and worker’s compensation. Medicare beneficiaries, attorneys, insurers, self-insured entities, third party administrators, and their agents are always responsible for understanding when there is coverage primary to Medicare, notifying Medicare when applicable, and for paying appropriately. Specifically, liability insurers (including self-insurers), no-fault insurers, and workers' compensation insurers are required to report all claims including the establishment of the claim, termination of ongoing responsibility for medical (ORM), the total payment to the claimant (TPOC), and any settlement to CMS/Medicare under the Mandatory Insurer Reporting Requirements of Section 111 of the Medicare/Medicaid SCHIP Extension Act of 2007 (MMSEA). The data collected under Section 111 reporting is used by CMS/Medicare when processing claims billed to Medicare for reimbursement for items and services furnished to Medicare beneficiaries and for MSP recovery efforts. If a carrier does not provide the required Section 111 information to CMS/Medicare it can result in “a civil money penalty of up to $1,000 for each day of non-compliance with respect to each claimant.”
