I define a good mediator as one who facilitates communication between the parties and a great mediator as one who, in addition, helps the parties evaluate the respective strengths and weaknesses of their positions to create a realistic framework for an agreement. As a practicing attorney, I was disappointed that some mediators viewed their role as little more than messengers. In my experience, telephone calls to opposing counsel are a more efficient way of communicating. I hired a mediator with the expectation that a proactive third party might assist in settling a case I had already made every effort to settle with opposing counsel informally. Good lawyers don't need messengers; they need an experienced and pro-active mediator. My background in business and government service, coupled with my litigation and judicial experience, provide me with an outstanding and well-rounded foundation to assist the parties in resolving their dispute.
