- DivorceIt is becoming more common for couples to settle disputed matters in a divorce in a private mediation or arbitration session as opposed to a public courtroom. In Tarrant County, family courts actually require parties in contested divorces to attempt to resolve their differences with a professional mediator first. In a mediation session, a professional mediator, who might be an attorney, counselor or other service provider, assists a couple in reaching agreement on the disputed aspects of their divorce. An arbitration session is similar, except that the neutral third party is an arbitrator who will make a binding ruling on the disputes on which the two sides fail to reach an agreement. When compared with the cost of litigation, mediation and arbitration often can save considerable time and money for parties in a divorce. Arlington attorney Stephanie Foster is experienced in presenting her clients’ cases to an arbitrator or mediator. - Child SupportModification & Enforcement A divorce might appear fair when it is settled. However, with the passage of time, new circumstances may present themselves that make it necessary to change an agreement. There might be a need to ask the court to enforce or modify an order. The court may modify a child support, custody or visitation order, for example, if there has been a significant change in one party’s salary, or if a party must move to another city. The court also will take action to enforce an order if one of the parties is out of compliance or in contempt of court. The court may take punitive action against a parent who evades payment of child support, which could include garnishing their wages, suspending their driver’s license or placing them in jail. You should consult with an attorney experienced in the modification and enforcement of orders if you are seeking a change in a court order. The Law Offices of Stephanie A. Foster, P.C. in Arlington, Texas represents clients in cases related to child support, divorce, modification of orders and enforcement of orders. - Child Custody and VisitationThe Arlington collaborative lawyer distinguished herself as one of the first Tarrant County attorneys trained in “collaborative law,” which offers clients a less combative way to divorce. In collaborative law, there is no war and there are no court appearances. Instead, two or more attorneys work with their respective clients and a possible team of a communications coach and a financial planner/CPA to negotiate and agree on child custody, visitation and the equitable division of their marital assets and debts.
- AdoptionTermination of Parental Rights Stephanie Foster has helped Tarrant County families in terminating the parental rights of a non-supporting, biological parent. As part of the adoption process, the Foster Law Firm also files name change requests for children and adults. It also handles other adoption-related matters for families. - Spousal SupportAlimony Lawyer - Spousal Support Attorney Under Texas law, spouses married for at least a decade and can not meet their reasonable minimum needs due to a limited earning capacity may be entitled to post-divorce maintenance after a divorce. Spousal maintenance can be ordered for a period of three years and may be for a longer period, if warranted by the statute. During the temporary order phase of a case, the court may order temporary spousal support as spouses have a duty to support one another under our Texas Family Code. - Restraining OrderWhen a respondent is served with an original petition for divorce, it may include a temporary restraining order (TRO) and/or a notice of a hearing setting the temporary order hearing. A TRO is an injunction and is valid for 14 days. It prevents the respondent from taking any actions that negatively affect the marital estate. Such an injunction also typically includes restrictions to keep the respondent from threatening or harassing their spouse. If children are involved, it enjoins the respondent from hiding or secreting the children from the petitioner, from removing them from the jurisdiction of the court, and from withdrawing them from school or day care. When the parties appear in court for temporary orders, a judge rules on whether or not the injunction should be extended or become permanent.
