- Landlord-Tenant DisputesWhether you are a Landlord or a Tenant, you probably already know how complicated Washington’s Landlord-Tenant laws have become. For example, did you know that Tenants may be entitled to up to 4 different notices prior to an eviction? (Each notice is required to be prepared and given to the Tenant in a different manner). It is easy to get lost in the maze of law, paperwork, legal jargon and court hearings. An experienced lawyer can provide the answers and assistance you need. The attorneys at LOMBINO • MARTINO have substantial experience in advising and representing Landlords and Tenants in every facet of the Landlord and Tenant contractual relationship to include advising Landlords and Tenants as to their particular rights and obligations under the law through the eviction process.
- Personal InjuryWho pays my medical bills if I become involved in an automobile accident? If you have Personal Injury Protection through your automobile insurance policy, your insurance company should pay your medical bills (up to a certain limit). An injury victim must be careful, however, because your insurance company will pay only those medical expenses that they deem related to the injuries you received in your accident and that are reasonable and necessary for the treatment of those injuries. Your insurance company generally will have a claim for reimbursement for the medical expenses they pay from the insurance company of the “at fault” driver (this is called “subrogation”). However, your attorney may be able to negotiate a reduction of that reimbursement, or subrogation, thereby increasing the settlement proceeds that you actually receive.
- Estate PlanningEstate Planning is one of the most important actions you can take to protect your family. Taking the appropriate steps to plan ahead for an uncertain future can make all the difference in the world to your loved ones. It is important that your wishes are made clear through an estate plan so that, in the event tragedy strikes, they will be cared for and your legacy secured. Some critical issues that must be considered and addressed in your estate plan are: to whom you wish your assets to be distributed upon your passing; how you wish those assets to be distributed; how such a distribution would affect your beneficiaries; and who would care for your children in the event of your untimely passing. In addition, your Estate Planning can include who would pay your bills and make decisions regarding your personal care in the event you were no longer capable of making these decisions for yourself.

- TrustsA trust is a fiduciary relationship that allows a third party, or trustee, to hold property or assets on behalf of one or more beneficiaries, subject to the terms of the rules described in the trust agreement. There are different types of trusts that serve different purposes. Purposes of trusts include reducing estate tax liability, controlling the use of the trust property, and avoiding probate. Generally, they fall into one of two categories: testamentary trusts or inter vivos or living trusts.

- BankruptcyHave you ever found yourself in a position of not being able to pay your bills because of circumstances beyond your control? Maybe you suffered from a medical problem and you are being crushed under the weight of all the medical bills. Perhaps you lost your job and no longer have the ability to pay your everyday living expenses. If you are in a situation where you simply cannot pay your bills, our attorneys at LOMBINO ∙ MARTINO are here to help you. You may be eligible for Federal Bankruptcy protection. Chapter 7 of the United States Bankruptcy code provides an opportunity for some people to discharge most, if not all, of their unsecured debt, including credit cards and medical bills. Upon the filing of a Bankruptcy Petition, your creditors will no longer be able to harass you, try to collect on their debts or garnish your wages (this is known as the “automatic stay”). In addition, you may very well be able to keep your home, vehicle and other possessions that are important to you. The United States Bankruptcy code not only allows debtors to discharge their debt, it allows a debtor to begin rebuilding their credit very quickly! In most cases, you could expect your Chapter 7 Bankruptcy case to be completed and resolved in 3 to 4 months. Federal Bankruptcy protection can provide a “fresh start” in your life.
- ForeclosureHome ownership is one of the biggest commitments and responsibilities that one can take on during one’s lifetime. Whether you are a first time homebuyer, refinancing, selling your home, or dealing with the challenges of keeping a home in the current economy, having an attorney guide you through the process can provide you with the support necessary to make the right decisions for you and your family. From the review of your purchase and sale agreement and loan documents to discussing the difficult loss mitigation issues of short sale, deed in lieu of foreclosure, and foreclosure – our attorneys are here to listen and convey their expertise. Our attorneys at LOMBINO • MARTINO can provide you the tools you need to proceed by reviewing your contracts, discussing your options and being there to answer any questions throughout your transaction.
- Tax LawAn inter vivos or living trust is one that is created and funded during your life. The most common type of living trust is a Revocable Living Trust. A Revocable Living Trust (RLT) is an alternative to the traditional Will that allows a probate-free transfer of assets at death and allows for centralized management of assets during your lifetime should you become incapacitated. A RLT can also be split into two or more trusts to accomplish other desired goals, such as for tax planning, to protect children from prior relationships or to provide for a beneficiary with disabilities. It is important to consult with an attorney to fully explore your needs and goals to evaluate what device would work best for your estate plan.
