- Estate PlanningYour Will sets forth your plan for distribution of your property, may name a guardian to care for your minor children and otherwise expresses your wishes upon your death. If you die without a Will (or one of the other estate planning tools referenced above) and a probate is required, the Court will distribute your estate in accordance with state law and make decisions regarding the placement of your minor children – decisions that might not reflect your desires.
- WillsIf your loved one dies owning assets which did not pass through one of the many available estate planning tools, a probate may be necessary to transfer ownership to the heirs. During the probate process, the Court will appoint a Personal Representative to administer the estate. The Personal Representative will be required to locate, preserve and protect all assets and to identify and notify all creditors.
