• Divorce
  Division of assets in a divorce can be a challenge. David C. Winslow meets that challenge with years of divorce law experience and a business and personal background in real estate. David Winslow has extensive experience in equitable division of assets and has the know-how to resolve even the most complex financial situations, including those involving substantial assets, closely held businesses and commercial and residential real estate holdings.
• Child Support
  In California, every parent has an obligation to contribute to the support of his or her child. The court will issue an order regarding support payments, intended to provide the custodial parent with the necessary resources to provide for the child. The Court will issue child support orders almost immediately after filing a request. California family courts follow standard state guidelines for child support. In most situations the calculation of child support order is based on the incomes of both parents and the amount of time the child spends at each residence. The court has the limited discretion, however, to vary from the guideline if a child's needs or the resources or situation of a parent are exceptional.
• Child Custody and Visitation
  I have represented many types of people in their divorce or child custody matters. • Paternity
  When the identity of a child's father is in dispute, David C. Winslow can pursue paternity genetic (DNA) testing of of the purported father and the child to determine paternity. We also represent alleged fathers in paternity matters.
• Premarital Agreement
  Without a prenuptial agreement, you and your children could lose a substantial part of your estate in the event of a divorce. David Winslow can advise you how to avoid such a tragedy.
• Spousal Support
  A married couple is determined to be “separated” when they are living apart where one party has the intent not to reconcile. This date of separation is important when determining the length of spousal support, the extent of property rights, and pension rights. The length of your marriage is the time between your marriage date and the date of separation.
• Legal Separation
  No Court papers need to be filed to establish the date of separation. Many people confuse their date of separation with Legal Separation. Legal Separation is one of the choices, along with Dissolution (Divorce) and Nullity, when filing the case with the Court.

Criminal Law

• Restraining Order
  Civil Harassment matters are requests for the Court to issue a restraining order in matters that do not involve a domestic relationship. To prevail in a civil harassment case you must prove that unlawful harassment is taking place. This means that the perpetrator is doing something illegal directed at the victim (and not just a third party.) There must be a course of conduct that is directed at the victim.
