- Child SupportChild support payments in Michigan are governed by a strict formula contained in the Michigan Child Support Manual. The computation of the payments takes into account the income of both spouses, the number of children involved, and other support obligations like paying for a personal life insurance or a health insurance policy. The amount of child support that a person is required to pay is calculated without regard to their current expenses. It is presumed that child support payments will take a top priority when a person sits down to write checks at the end of the month.

No parent wants to be away from their children for even one day, but in a child custody hearing a judge will ultimately determine what is in the best interest of the children. A judge will seek to provide the children with safety, stability and continuity, with a minimum of disruptions, so that they can maintain the lifestyle to which they have grown accustomed to.
- Spousal SupportAlimony is now referred to as “spousal support” and is an important element in the divorce process. Alimony is an amount of money that a spouse will pay to the other on a monthly basis in order to support them and the amount of the payments are separate from any property settlements. The amount of the alimony payments are determined by a judge and is aimed toward helping both parties maintain the lifestyle that they are accustomed to. There are many factors that a judge will take into consideration when determining who gets the alimony payment and how much.
- Child AbuseOne of the benefits of mediation is that it is usually less expensive than a full-blown trial and is also much quicker. Couples with little personal property often choose mediation. You and your spouse control the mediation process and you are not relinquishing decision-making responsibility to a judge. Mediation is not recommended when a history of spousal abuse or domestic violence has occurred. This is particularly true if the couple has a history of child abuse or neglect. If one party or the other is medically unable to represent themselves, the mediator may recommend that a lawyer represents them at trial.

- DUI/DWIThere are several requirements that you must meet if you wish to apply to have your criminal record expunged. If you have been convicted of only one offense, you may file an application under Michigan law to have the conviction, even a felony, set aside and your record cleared. You must have a perfectly clean criminal record for at least five years after you were convicted or finished serving your jail sentence, whichever is later before you can apply to have your conviction cleared from the record. No expungement is possible for drunk driving or sexual crimes. Also, no expungement will be possible while you have open charges. Any prior criminal conviction where there was a victim will require the victim to be notified. The victim has the right to make a written or oral statement before the court.
