Collections I believe you deserve to be paid for the services or goods you worked so hard to provide. Collecting that money can sometimes be difficult without an attorney involved to show the other side you are serious. I have experience collecting from consumers as well as commercial entities, all while adhering to the Fair Debt Collection Practices Act, local and state rules. I provide excellent service and work hard to negotiate terms before filing costly court complaints, though at times getting the court involved is unavoidable. I continue to negotiate, however, before a trial to save you litigation fees and costs. Spending all the money you are owed does not do you any good, so it is my priority to get you as much as possible while spending little. My rates are competitive in order to maximize your return. Landlord Evictions Being a landlord is hard work. The most important rights you have as a landlord are to be paid rent timely and for your property to remain free from damage. If a tenant is breaking the terms of his/her lease, it may be best for the landlord to commence an eviction action. I know the local court rules to allow your eviction to go through with ease. Failing to know the rules can cause a tenant to be improperly evicted or a landlord to have to start the process all over again. I can help you get it right the first time by providing you with proper notices to leave, a thorough complaint in court, and ensuring a set out if the tenant remains in the property. Consumer Protections Do you have creditors calling you at home or work and constantly harassing you? Are you afraid to pick up the phone? You are not alone. If you feel a creditor has engaged in abusive, deceptive, unfair collection practices, or has backed out of a settlement agreement that they previously made with you, you may be entitled to a monetary award. There are laws in place to make sure you are treated fairly regardless of how much money you owe, if any at all. It is up to the creditor to prove what you owe. Let me be your shield during this embarrassing time and protect you from those creditors. If you are already being sued by a creditor, I can help you file an answer. However, time is of the essence, as you only have 28 days from your date of service to file an answer in court. Not doing so can lead to a default judgment against you, which can hurt your credit rating and lead to a garnishment of wages. I will work tirelessly to negotiate a fair settlement before having to ever attend court. If you have paid off a debt and your credit report still shows a negative rating or if an accurate negative rating is on your credit for longer than seven years (ten with a bankruptcy), I can aid in clearing that up. The major credit bureaus are Transunion, Experian and Equifax. You are entitled to one free credit report every twelve months. If your credit report shows an error, a dispute letter must be sent to the bureau, as well as a copy to the creditor, who then has thirty days to rectify the error. If this does not occur, a lawsuit can be filed. I specialize in ensuring the Fair Debt Collections Practices Act (FDCPA) and Fair Credit Reporting Act (FCRA) are enforced. Under the FDCPA and FCRA, you are entitled to statutory damages, actual damages, emotional distress damages and attorney's fees and costs if violations have occurred.
