- Intellectual PropertyIntellectual property litigation can be very complex. It can involve patent infringement, trademark infringement, trade secret misappropriation, copyright violation, license agreement violations, and unfair competition claims. Protected patents, trademarks, licenses, and copyrights enhance the value of our clients’ property and inventions, and we work vigorously to defend their rights to the worth of their creations. We have structured licensing programs for clients such as proprietary software developers. We have also represented our clients in litigation when those licenses have been infringed upon. We have negotiated non-compete agreements for employees of small technology firms. We investigate the allegations when clients are notified that they have infringed upon or violated another person’s rights to intellectual property. Our experience shows us that some claims of intellectual property violation are merely designed to generate funds, while others are legitimate and lawful protections of creative and inventive work. When the allegations are spurious, we vigorously defend our client’s rights and intellectual property through litigation. When there is merit to the case, we use our well-developed negotiation skills to arrive at a solution satisfactory to all parties.

- Employment LitigationThe world however is not ideal, and no one can guarantee that each person will be fulfilled with his or her work. Nevertheless, every worker is entitled to receive fair and timely pay. Both state and federal laws protect the rights to fair compensation and timely paychecks. In addition, the law protects employees from workplace discrimination based on factors like age, race, gender, national origin, pregnancy, and religion. The laws in this area are complex and change yearly. It is often difficult for employee and employer alike to determine proper compliance and classification. Many times such issues are not resolved until they advanced in lawsuits and then, not even until they reach the appellate courts. Contact our experienced Miami employment litigation attorneys for more information.
- Non-compete AgreementOften the battle over restrictive covenants involves whether or not the plaintiff had a legitimate business interest justifying the restrictive covenant. Many companies have everyone of their employees sign non-compete agreements regardless of their positions, training, knowledge and business interests. Because free trade and employment is valued in our society, contracts in restraint of trade or employment are looked at by the courts narrowly and strictly construe same. In addition, courts may also consider whether the restrictions contained in the agreement are reasonable in time, area and line of business. If unreasonable, the court may refuse to enforce the agreement.
