• Wrongful Death
  Wrongful death was a claim started under the common law where a person or entity could be held liable for a death. The claim is a civil action, usually brought by a spouse or children of a dead person which alleges that a victim died due to negligence on the part of the defendant. Surviving dependents or beneficiaries of the decedent can be entitled to monetary compensation for damages caused due to the death of the victim. Wrongful death can arise from a number of circumstances, including automobile or airplane accidents, occupational accidents or exposure to hazardous substances; criminal behavior; and other instances by a third party.

  Sexual conduct or misconduct, sexual abuse or molestation, sexual exploitation, sexual touching, sexualized interaction, sexual comments about a person’s body, or other verbal or non-verbal behaviors that facilitated, contributed to, or led up to abuse, regardless of whether or not such behavior was itself sexual or against the law, and regardless of whether the child thought the behavior was sexual abuse at the time.

  David Schnitzer began his legal career in Portsmouth, Virginia in 1997, and dedicated the first 10 years of his practice to representing injured railroad workers in accordance with the Federal Employers’ Liability Act. David relocated to Florida in 2008 and continued to grow his trial practice while handling a wide variety of civil litigation matters, including residential foreclosure defense, community association law, construction defects, and divorce. In 2017, David founded a divorce and family mediation firm, and as a Florida Supreme Court-certified family mediator, he helped divorcing couples to amicably resolve their disputes without the need for expensive and traumatic proceedings in court. David joined The Moody Law Firm in 2022 and is proud and excited to return to his legal roots handling FELA matters for injured railroad workers and otherwise representing individuals that have suffered harm as a result of the negligence or misconduct of others.
